Abstract:	本研究認為為達量刑操作精緻化，提升量刑之妥適、透明、公平及合理可預測性，避免不合理之量刑歧異，完善刑事案件量刑法制，不僅有待於實體量刑之改革，更有待於量刑程序法制之建構，若有涉及侵害人民正當法律程序權，亦有待於法律明文授權為之，方符合憲法誡命及限制。準此，本研究將提供我國相關法制未來立法或進一步修法時的基礎思維與方向，藉此完善我國量刑程序法制，並更凸顯本研究之重要性及預期影響性。
