漏水問題是現今建築工程保固維修上,最棘手與維修成本最高的問題,以往建商與客戶間定型化保固契約,已無法滿足快速經濟成長的社會需求,在消費者意識抬頭情形下,以往責任不清,權利不明的定型化保固契約,只有徒增雙方爭議糾紛,並無法保障雙方權益。爰此,本研究針對自地自建之建設公司與房屋所有權人,在建築工程漏水保固差異化之競爭策略作為研究對象與研究主題,目的在制訂可以保障消費者且能兼顧建商權益的漏水保固差異化之競爭策略。並藉由文獻分析及相關學者研究心得,在民法及消費者保護法架構下探討漏水瑕疵問題,於買賣行為與產品責任和瑕疵擔保的法律關係,配合現況訪談結果,研擬出一套具多樣化功能,因應市場競爭、創造客戶滿意度、強化建商行銷之漏水瑕疵保固差異化之競爭策略。本研究所得到的主要成果包括: 1. 將漏水原因以瑕疵類型歸納之。 2. 建立漏水瑕疵認定原則之判定標準。 3. 依據法令規定強化本研究立論基礎。 4. 確立漏水問題保固責任與權利行使之主體與程序。 5. 釐清建商、客戶與市場性三方面有關漏水保固問題的負面因素。 6. 制訂保固約期、維修補償、風險對價等保固策略,供建商因案制宜地彈性搭配與靈活運用。 In Taiwan, leakages are the most prevalent defects seen in building construction. Building developers traditionally provide defect warranties to cover leakage problems. However, such standardized form warranties are deficient in meeting consumer’s various needs. Worse even, these standardized warranty clauses may contradict to conditions clearly required by civil law or consumer protection act. In contemporary developer’s market, product differentiation is crucial for survival and long-term sustainability. Differentiation in leakage warranties may well become a powerful weapon to distinguish a developer from its peers. The core of this study is to envision the exact content of such a warranty product. This study incorporates various requirements given in civil law (in contract and tort laws) and consumer protection act. Substantial effort is also given to elicit practical experiences concerning effective leakage warranty agreements and undertakings. The main contribution of this study includes formalization of causes of building leakage in Taiwan, the proper criteria to rate building leakages, identification of the subject matter concerning leakage liability and warranty procedure, and the introduction of a warranty system with special consideration of the equilibrium of risk and price.
